By using BreakAway, you agree to:

• Follow these Terms of Service completely
• Take full responsibility for your digital discipline journey
• Respect the app's purpose: helping you break free from digital distractions

2. What BreakAway Is

BreakAway is a digital wellness app designed to help serious individuals take control of their device usage through:

• App and website blocking with Scroll Guard technology (Android)
• AI Task Manager to create and manage tasks through natural conversation
• Reality Check AI that makes you reflect before accessing blocked apps
• Progress tracking, streak building, and Free Days rewards
• 8 motivational voice coaches to keep you accountable
• Home screen widget for task management

3. Your Responsibilities

As a BreakAway user, you commit to:

Personal Accountability

You are 100% responsible for your digital habits and the consequences of using or not using BreakAway. We provide the tools; you provide the discipline.

Honest Usage

Use BreakAway for its intended purpose — building better digital habits. Don't try to game the system or find workarounds just to avoid doing the work.

Audio Content Responsibility

The motivational audio messages are designed to encourage discipline and focus. You are responsible for using appropriate volume levels and ensuring audio doesn't disturb others or violate any rules in your environment.

Emergency Override Responsibility

You can configure emergency override settings in the app. It's your responsibility to set these up appropriately for your safety needs.

Device Security

Keep your device secure. BreakAway's effectiveness depends on your device's security settings and your commitment to the process.

4. What We Provide

Core Features:

• App and website blocking with customizable schedules
• Scroll Guard — intelligent doom-scroll detection (Android only)
• AI Task Manager — create tasks through natural conversation
• Reality Check AI — mindful reflection before accessing blocked apps
• 8 voice coaches with unique motivational styles
• Usage tracking and analytics
• Streak tracking with milestone badges
• Free Days rewards program
• Home screen widget for tasks
• Cross-device backup and restore (with Google sign-in)

Subscription Required:

BreakAway requires an active subscription or Free Days balance to access all features. See Section 12 for pricing and the Free Days program.

5. Account and Data

Your Account:

• Optional Google Sign-In: You can connect Google to back up your streaks, rewards, and subscription across devices. Your Google account ID is also used for referral fraud prevention.
• Local Data: Your progress, streaks, and usage data stay on your device
• Account Deletion: You can delete your account anytime through app settings
• Data Export: Your local data remains on your device when you delete your account

Our Commitment:

• We don't sell your data to third parties
• We don't store your app usage data on our servers
• Your Google sign-in (if linked) is used for cross-device backup, subscription continuity, and referral fraud prevention — not for any other purpose

6. App Functionality and Limitations

Blocking Features:

• User Control: You control all blocking settings and can configure emergency overrides
• Device Permissions: BreakAway requires specific permissions to function effectively (Accessibility Service on Android; Screen Time API on iOS)
• No Guarantees: While BreakAway is designed to help you stay focused, your success depends on your commitment

Technical Limitations:

• Device Compatibility: BreakAway works on Android 5.0+ and iOS 15+ with required permissions
• System Updates: OS updates may affect app functionality
• Battery Optimization (Android): Proper configuration is required for consistent blocking

Emergency Access:

• Your Responsibility: Configure emergency override settings appropriately
• No Liability: We are not responsible if blocking interferes with emergency communications due to your configuration choices

7. AI Features Terms of Use

BreakAway includes AI-powered features (AI Task Manager and Reality Check AI) that use Google's Gemini AI (primary) and Anthropic's Claude AI (fallback). By using these features, you agree to:

Acceptable Use:

• Use AI features only for their intended purpose (task management and mindful reflection)
• Not attempt to manipulate, jailbreak, or misuse the AI assistant
• Not use AI features to generate harmful, illegal, or inappropriate content
• Understand that AI responses are suggestions, not professional advice

AI Limitations:

• AI features are designed for task management only and will redirect off-topic requests
• The AI may occasionally provide incorrect or unhelpful responses
• AI features require an internet connection to function
• We reserve the right to limit AI usage to prevent abuse

Third-Party Processing:

AI conversations are processed by Google's Gemini API and Anthropic's Claude API. Your use of AI features is also subject to Google's Terms of Service and Anthropic's Terms of Service. We send only the text of your messages — no personal identifiers are shared with either provider.

8. Intellectual Property

Our Rights:

• BreakAway app, name, logo, and all content are owned by ListenToMe LLC
• All audio content, including motivational messages and voice recordings, are owned by or licensed to ListenToMe LLC
• You cannot copy, modify, distribute, or reverse engineer our app or audio content
• You cannot use our trademarks, branding, or audio content without permission
• You cannot extract, record, or redistribute our audio messages

Your Rights:

• You own your personal data and progress
• You can export your local data anytime
• You have a license to use BreakAway and its audio content according to these terms
• Audio content is for personal use only within the BreakAway app

9. Prohibited Uses

Don't use BreakAway to:

• Violate any laws or regulations
• Interfere with other users' experience
• Attempt to hack, reverse engineer, or compromise the app
• Extract, record, copy, or redistribute our audio content
• Use the app or its content for any commercial purpose without permission
• Share your account credentials with others
• Use audio content outside of the BreakAway app

10. Disclaimers and Limitations

BreakAway is not medical advice or treatment. If you have concerns about technology addiction or mental health, consult qualified professionals.

Audio Content Disclaimer:

• Motivational audio messages are for encouragement and accountability purposes only
• Audio content may contain strong motivational language designed to promote discipline
• We are not responsible for how you interpret or react to motivational content
• Adjust volume appropriately for your environment and hearing protection

No Warranties:

BreakAway is provided "as is" without warranties of any kind. We don't guarantee the app will meet your specific needs or be error-free.

Limitation of Liability:

ListenToMe LLC is not liable for any damages arising from your use of BreakAway, including but not limited to:

• Lost productivity or missed opportunities
• Device or data issues
• Emergency communication interference (when you configure override settings)
• Reactions to or interpretation of audio content
• Hearing damage from improper volume usage
• Any indirect, incidental, or consequential damages

11. Privacy and Data Protection

Your privacy is governed by our Privacy Policy, which is incorporated into these terms. By using BreakAway, you also agree to our Privacy Policy.

Key points:

• Your app usage data stays on your device
• Google sign-in is optional and used for cross-device backup, subscription continuity, and referral fraud prevention
• We comply with applicable privacy laws including the New Jersey Data Privacy Act

12. Subscription and Payment Terms

Subscription Pricing:

BreakAway is free to download with a 7-day free trial. Pricing varies by country to reflect local purchasing power. See your local price in the App Store or Google Play.

Subscriptions are managed through the App Store (iOS) or Google Play (Android) and automatically renew unless cancelled at least 24 hours before the end of the current period.

Free Days Program:

You can use BreakAway without paying by earning Free Days through discipline and referrals:

Referral Rewards:

• 30 free days per friend who joins BreakAway using your referral code — 3 days when they sign up, and 27 more after their first 3 active days
• No limit on referral rewards — invite more friends, earn more free time

Streak Milestone Rewards:

• 7-day streak: 1 free day
• 21-day streak: 2 free days
• 50-day streak: 3 free days
• 100-day streak: 4 free days
• 150-day streak: 5 free days
• 250-day streak: 5 free days
• 330-day streak: 10 free days

Total Days Milestone Rewards:

Earn additional free days based on your cumulative successful days under your usage limit:

• 14 total days: 1 free day  |  30 days: 2 free days  |  60 days: 4 free days
• 90 days: 5 free days  |  120 days: 6 free days  |  180 days: 8 free days
• 240 days: 9 free days  |  300 days: 10 free days  |  360 days: 15 free days

How Free Days Work:

• Free Days are automatically applied before your subscription renewal
• You can enable auto-apply in settings (applies when within 7 days of renewal)
• Free Days do not expire as long as your account remains active
• Free Days cannot be transferred or exchanged for cash

Cancellation and Refunds:

• Android: Cancel through Google Play → Subscriptions → BreakAway → Cancel
• iOS: Cancel through Settings → Apple ID → Subscriptions → BreakAway → Cancel
• Access continues until the end of your current billing period
• Refunds are handled according to the respective platform's refund policy (Google Play or App Store)
• Unused Free Days are not refunded upon account deletion

13. Changes to Terms

We may update these Terms of Service as BreakAway evolves. We'll notify you of significant changes through:

• In-app notifications
• Updated terms posted in the app

14. Termination

You Can:

• Stop using BreakAway anytime
• Delete your account through app settings
• Uninstall the app from your device

We Can:

• Discontinue BreakAway (with reasonable notice)
• Update features and functionality
• Modify these terms (with notice)

15. Dispute Resolution

Governing Law:

These terms are governed by New Jersey state law, USA.

Dispute Process:

1. Direct Contact: Contact us first at support@breakaway-app.com
2. Good Faith Resolution: We'll work to resolve issues directly
3. Legal Action: If needed, disputes will be resolved in New Jersey courts

No Class Actions:

You agree to resolve disputes individually, not as part of class action lawsuits.
