1. Acceptance of Terms

By using BreakAway, you agree to:

• Follow these Terms of Service
• Use BreakAway for lawful personal digital-wellness purposes
• Respect the app's intended purpose as a digital-wellness tool
• Use BreakAway only if you are at least 13 years old, and only with parent or guardian consent if you are under the age of majority where you live

2. What BreakAway Is

BreakAway is a digital wellness app designed to help users take control of their device usage through:

• App and website blocking with Scroll Guard technology (Android)
• AI Task Manager to create and manage tasks through natural conversation
• Reality Check AI that makes you reflect before accessing blocked apps
• Progress tracking, streak building, and eligible rewards when available
• Friend, chat, group, and competition features
• Home screen widget for task management

3. Your Responsibilities

As a BreakAway user, you commit to:

Personal Accountability

You are responsible for how you configure and use BreakAway. We provide tools designed to support digital discipline, but we do not guarantee any specific personal, productivity, health, or behavioral outcome.

Honest Usage

Use BreakAway for its intended digital-wellness purpose. Do not abuse rewards, referrals, competitions, subscriptions, support systems, or technical systems.

Emergency Override Responsibility

You can configure emergency override settings in the app. It's your responsibility to set these up appropriately for your safety needs.

Device Security

Keep your device secure. BreakAway's effectiveness depends on your device settings, operating system behavior, and how you configure the app.

User Content Responsibility

You are responsible for the tasks, notes, messages, profile photos, screenshots, videos, audio, support attachments, and other content you create, upload, or send through BreakAway. Do not submit content unless you have the legal right to use and share it.

4. What We Provide

Core Features:

• App and website blocking with customizable schedules
• Scroll Guard — intelligent doom-scroll detection (Android only)
• AI Task Manager — create tasks through natural conversation
• Reality Check AI — mindful reflection before accessing blocked apps
• Daily limit and progress tracking
• Streak tracking with milestone badges
• Eligible rewards program when available
• Friend, chat, group, and competition features
• Home screen widget for tasks
• Cross-device backup and restore (with supported sign-in methods)

Access:

BreakAway may provide full access for free while the app is being polished. When Premium is enabled, an active subscription, saved Free Days balance, or other eligible access period may be required for some or all paid features. See Section 12 for payment and Free Days terms.

5. Account and Data

Your Account:

• Optional Sign-In: You can use supported sign-in methods, including Google, Apple, and email/password where available, to back up your streaks, rewards, and subscription across devices. Account identifiers may also be used for referral fraud prevention, account security, and subscription continuity.
• Local Data: Raw screen-time and app-usage history are processed on your device. Account, subscription, rewards, analytics, support, task sync, profile, social, competition, friend and group chat, and optional AI feature data may be processed as described in the Privacy Policy.
• Account Deletion: You can delete your account anytime through app settings
• Data Export: You can export available app data before deletion

Our Commitment:

• We don't sell your data for money. We use Google Analytics on our website for aggregate traffic and conversion measurement with advertising storage and ad personalization disabled, and we do not currently use Meta Pixel or advertising SDKs for targeted advertising
• We don't store raw screen-time or app-usage history on our servers
• Your linked sign-in methods are used for account access, cross-device backup, subscription continuity, security, support, and referral fraud prevention

6. App Functionality and Limitations

Blocking Features:

• User Control: You control all blocking settings and can configure emergency overrides
• Device Permissions: BreakAway requires specific permissions to function effectively (Accessibility Service on Android; Screen Time API on iOS)
• No Guarantees: While BreakAway is designed to help you stay focused, your results depend on your configuration, device settings, operating system behavior, and personal use

Technical Limitations:

• Device Compatibility: BreakAway is live on Android 5.0+ and iOS 15+ with required permissions
• System Updates: OS updates may affect app functionality
• Battery Optimization (Android): Proper configuration is required for consistent blocking

Emergency Access:

• Your Responsibility: Configure emergency override settings appropriately
• No Liability: We are not responsible if blocking interferes with emergency communications due to your configuration choices

7. AI Features Terms of Use

BreakAway includes AI-powered features, including AI Task Manager and Reality Check AI. By using these features, you agree to:

Acceptable Use:

• Use AI features only for their intended purpose (task management and mindful reflection)
• Not attempt to manipulate, jailbreak, or misuse the AI assistant
• Not use AI features to generate harmful, illegal, or inappropriate content
• Understand that AI responses are suggestions, not professional advice

AI Limitations:

• AI features are designed for task management only and will redirect off-topic requests
• The AI may occasionally provide incorrect or unhelpful responses
• AI features require an internet connection to function
• We reserve the right to limit AI usage to prevent abuse

Third-Party Processing:

AI conversations are processed by Google's Gemini API and, when Gemini is unavailable, Anthropic's Claude API. We send the text, task context, and saved-location context reasonably needed to provide the feature. Your use of AI features is also subject to the applicable provider terms, including Google's Gemini API terms and Anthropic's Terms of Service.

8. Intellectual Property

Our Rights:

• BreakAway app, name, logo, software, design, and content are owned by ListenToMe LLC or its licensors
• You cannot copy, modify, distribute, or reverse engineer our app or content
• You cannot use our trademarks, branding, or content without permission

Your Rights:

• You own your personal data, progress, chat messages, support recordings, and other user content you create or submit
• You can export your local data anytime
• You have a license to use BreakAway according to these terms

Your Content and License to Us:

You keep ownership of content you create or upload, including text, images, videos, audio, chat messages, support recordings, and feedback. By submitting content to BreakAway, you give ListenToMe LLC a limited, worldwide, non-exclusive license to host, store, process, transmit, display, and use that content only as needed to operate BreakAway, provide support, process feedback, enforce these Terms, comply with law, and improve app reliability.

Copyright Complaints and DMCA Process:

If you believe content in BreakAway infringes your copyright, send a notice to support@breakaway-app.com with: your physical or electronic signature, identification of the copyrighted work, identification of the allegedly infringing material, your contact information, a statement that you have a good-faith belief the use is unauthorized, and a statement under penalty of perjury that the information is accurate and you are authorized to act for the copyright owner.

We may remove or disable access to allegedly infringing content and may terminate access for repeat infringers. If your content was removed by mistake, you may send a counter-notice with the information required by law. To claim full DMCA safe-harbor protection, ListenToMe LLC must maintain a current DMCA designated agent registration with the U.S. Copyright Office and keep the public agent information current.

App Store and Platform Terms:

If you downloaded BreakAway from the Apple App Store or Google Play, your use of BreakAway is also subject to the applicable store terms, usage rules, payment terms, subscription terms, and refund rules. Apple and Google are not responsible for providing maintenance or support for BreakAway. To the extent required by Apple's terms, Apple and its subsidiaries are third-party beneficiaries of these Terms for iOS users and may enforce the relevant provisions against you.

Export and Sanctions Compliance:

You may not use, export, re-export, or transfer BreakAway except as allowed by applicable law, including U.S. export control and sanctions laws. You represent that you are not located in a country or region subject to applicable embargoes or sanctions and are not listed on any applicable restricted-party list.

9. Prohibited Uses

Don't use BreakAway to:

• Violate any laws or regulations
• Interfere with other users' experience
• Attempt to hack, reverse engineer, or compromise the app
• Upload, send, or store content that infringes someone else's copyright, trademark, privacy, publicity, or other rights
• Upload or send content unless you own the rights to that content or have all permissions needed to use it in BreakAway
• Upload illegal, exploitative, abusive, harassing, deceptive, or malicious content
• Use the app or its content for any commercial purpose without permission
• Share your account credentials with others
• Use BreakAway where prohibited by applicable export, sanctions, or local law

10. Disclaimers and Limitations

Medical Disclaimer:

BreakAway is not medical advice or treatment. If you have concerns about technology addiction or mental health, consult qualified professionals.

No Warranties:

BreakAway is provided "as is" without warranties of any kind. We don't guarantee the app will meet your specific needs or be error-free.

Limitation of Liability:

ListenToMe LLC is not liable for any damages arising from your use of BreakAway, including but not limited to:

• Lost productivity or missed opportunities
• Device or data issues
• Emergency communication interference (when you configure override settings)
• Any indirect, incidental, or consequential damages

11. Privacy and Data Protection

Your privacy is governed by our Privacy Policy, which is incorporated into these terms. By using BreakAway, you also agree to our Privacy Policy.

Key points:

• Raw screen-time and app-usage history are processed on your device
• Task sync, profile, social, competition, friend and group chat, support messages, feedback attachments, AI feature input, and subscription/reward data may be processed or stored as described in the Privacy Policy
• Supported sign-in methods are optional and used for account access, cross-device backup, subscription continuity, security, support, and referral fraud prevention
• We use Google Analytics on our website for aggregate traffic and conversion measurement with advertising storage and ad personalization disabled, and we do not currently use Meta Pixel or advertising SDKs for targeted advertising

Email and Promotional Communications:

We may send transactional emails about your account, subscription, support requests, legal notices, security, and service updates. If we send marketing or promotional emails, they must include a clear way to unsubscribe, must not use deceptive subject lines or sender information, and must include a valid physical postal address as required by applicable law.

12. Subscription and Payment Terms

Subscription Pricing:

BreakAway may offer full access for free while the product is being polished. When paid plans are enabled, U.S. pricing may be $12.99/month or $49.99/year, and prices in other countries may vary based on App Store and Google Play regional pricing, taxes, currency conversion, and store rules. The exact price, billing period, introductory terms, renewal date, and cancellation terms are shown by the App Store or Google Play before purchase.

Subscriptions are managed through Google Play (Android) and the App Store (iOS). Store subscriptions automatically renew unless cancelled before the renewal deadline shown by the store. Deleting your account or uninstalling BreakAway does not cancel your subscription.

Free Days Program:

You may be able to extend access by earning Free Days through eligible milestones, referrals, and competition rewards:

Referral Rewards:

• 30 free days per eligible friend who joins BreakAway using your referral code — 3 days when they sign up, and 27 more after their first 3 active days
• Referral rewards are subject to eligibility, fraud-prevention checks, abuse controls, and program changes

Streak Milestone Rewards:

• 7-day streak: 1 free day
• 21-day streak: 2 free days
• 50-day streak: 3 free days
• 100-day streak: 4 free days
• 150-day streak: 5 free days
• 250-day streak: 5 free days
• 330-day streak: 10 free days

Total Days Milestone Rewards:

Earn additional free days based on your cumulative successful days under your usage limit:

• 14 total days: 1 free day  |  30 days: 2 free days  |  60 days: 4 free days
• 90 days: 5 free days  |  120 days: 6 free days  |  180 days: 8 free days
• 240 days: 9 free days  |  300 days: 10 free days  |  360 days: 15 free days

How Free Days Work:

• Free Days are saved to your account until you apply them to an active subscription or eligible access period
• Applied Free Days extend BreakAway access for the account where they are applied
• Free Days do not expire as long as your account remains active
• Free Days cannot be transferred or exchanged for cash
• We may change, pause, or end the Free Days program if needed for fraud prevention, abuse prevention, store compliance, or business reasons, but already-earned valid Free Days will remain available unless obtained through abuse or error

Cancellation and Refunds:

• Android: Cancel through Google Play → Subscriptions → BreakAway → Cancel
• iOS: Cancel through Settings → Apple ID → Subscriptions → BreakAway → Cancel
• Where available, BreakAway may also provide a Manage Subscription link in app settings that opens the App Store or Google Play cancellation flow
• Access continues until the end of your current billing period
• Refunds are handled according to the respective platform's refund policy (Google Play or App Store)
• Unused Free Days are not refunded upon account deletion

13. Changes to Terms

We may update these Terms of Service as BreakAway evolves. We'll notify you of significant changes through:

• In-app notifications
• Updated terms posted in the app

14. Termination

You Can:

• Stop using BreakAway anytime
• Delete your account through app settings
• Uninstall the app from your device

We Can:

• Discontinue BreakAway (with reasonable notice where practical)
• Update features and functionality
• Modify these terms (with notice where required)
• Suspend or terminate access for abuse, fraud, security risk, legal compliance, repeated infringement, or serious violations of these Terms

15. Dispute Resolution

Governing Law:

These terms are governed by New Jersey state law, USA.

Dispute Process:

1. Direct Contact: Contact us first at support@breakaway-app.com
2. Good Faith Resolution: We'll work to resolve issues directly
3. Legal Action: If needed, disputes will be resolved in New Jersey courts

No Class Actions:

To the maximum extent permitted by law, you agree to resolve disputes individually, not as part of a class, collective, consolidated, or representative action.

17. Severability

If any part of these terms is found invalid or unenforceable, the rest remains in effect.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the complete agreement between you and ListenToMe LLC regarding BreakAway.

19. Terms-Specific Responsibilities

These Terms are about allowed use and responsibility boundaries. They are separate from the Privacy Policy, which explains data handling. The most important practical obligations are keeping your account secure, using app-blocking and AI features lawfully, managing subscriptions through the correct app store, and treating competitions, referrals, chats, and support channels honestly.

• Account responsibility: You are responsible for the actions taken through your account, including messages, competition participation, referral activity, and support uploads.
• Store responsibility: Subscription changes, cancellations, renewals, refunds, and app-store billing disputes must be handled through Apple or Google when the store manages the purchase.
• Feature responsibility: Blocking, strict settings, AI output, reminders, and competitions are support tools. You remain responsible for choices made after using them.
• Misuse boundaries: Do not abuse support, upload unlawful material, impersonate other people, manipulate rewards, interfere with the service, or use BreakAway in a way that harms others.
